This website, the ‘Site’ is operated by Wet Global - Pure Ionic Water. Throughout  the Site, the terms “we”, “us” and “our” refer to Pure Ionic Water.

You should also print a copy for your future reference and read our Privacy Policy, which covers how we use your personal information.

Pure Ionic Water offers this Site, including all information, tools and services available from this Site to you, the user, conditioned upon your  acceptance of all terms and conditions, policies and notices stated here. This means that by accessing or using any part of the Site, you agree to be  bound by these terms and conditions, the “Terms of Service”, including any of our additional terms, conditions and policies available on our Site that are referenced herein, including by hyperlink. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any of our services. These Terms of Service apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you are accessing this Site as a business or otherwise not as a consumer, you confirm that you have authority to bind the entity on whose behalf you use this Site.

These Terms of Service may change from time to time. The most up to date version will always be displayed here. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site, following the posting of any changes, constitutes confirmation by you that you have read and understood the Terms of Service as revised and you have accepted and agreed to be bound by those changes.

 

We use headings throughout these Terms of Service for convenience only and to assist you with navigating through them. The headings do not limit or otherwise affect these Terms of Service.

 

Our store is hosted on Shopify Inc. They provide us with the online e- commerce platform that allows us to sell our products and services to you.

 

SECTION 1 – USE OF OUR SITE

 

1.1 By agreeing to these Terms of Service, you represent that you are at least 18 years of age or, if greater the age of majority in your state or province of residence. This Site is not intended to be used by minors.

 

1.2 You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

 

1.3 Subject to these Terms of Service, you are authorised to use this Site and any of our products or services for your personal use only as a consumer/prospective consumer, collectively this is receiving the ‘Services’.

 

1.4 A breach or violation of any of the Terms will result in an immediate termination of your Services. However, we reserve the right to refuse the Services to anyone for any reason at any time.

 

1.5 You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Services, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature.

We reserve the right to terminate your use of the Services, this Site, or any related website for violating any of the prohibited uses.

2.1 Some content, user/customer comments, tools and links provided on our Site are from third parties and are not approved by us. Some products and services may include materials from third parties. We have no obligation to review or control third party content and we are not responsible for, nor do we necessarily endorse or agree with such content by its inclusion on this Site. 2.6 We may also, in the future, offer new services and/or features through the Site (including, the release of new tools and resources). For the avoidance of doubt, such new features and/or services shall also be subject to these Terms of Service.

We understand that this may cause our customers some inconvenience and will try where possible to do this at less busy times. However, we have no obligations to do so, and we shall not be liable for any loss, damages or other inconvenience caused to anyone as a result of our Site being inaccessible for any reason.

By using this Site, you agree to indemnify, defend and hold harmless WET Environmental Ltd and our parent, subsidiaries, holding companies, and each of their respective affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees (and you shall continue to indemnify them and hold them harmless), in respect of all losses, damages, liabilities, claims, demands and costs, including legal fees, which are suffered due to or arising out  of your breach of these Terms of Service including the documents they incorporate by reference, your use of this Site, your violation of any law, or any breach of the rights of any third party.

 

SECTION 5 - INTELLECTUAL PROPERTY 

 

5.1 All copyright, trademarks and all other intellectual property rights in all material and content made available on this website is owned by WET Environmental Ltd, its parent, subsidiary and holding companies and our suppliers and licensors, and you acknowledge and agree that it shall remain at all times vested in them. You are permitted to use this material and content only for your own personal, non-commercial use in order to facilitate your purchase and non-commercial use of our products and services.

 

5.2 You acknowledge and agree that any other use of the material and content of this Site is strictly prohibited. You may not copy, reproduce, publish, distribute, present as your own, present as affiliated with, commercially exploit, or create derivative works of our copyright, trademarks or all other intellectual property, including material and content available on this Site, nor may you assist any third party to do the same.

 

5.3 You may not link to our Site or its content without prior written permission by a legally authorised representative of WET Environmental Ltd in the form of a formal website linking agreement.

6.1 All prices and descriptions of products and services are subject to change at any time without notice, at our sole discretion. 

 

6.2 We reserve the right at any time to modify or discontinue the Services (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.

 

6.3 Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. Please view our full Customer Terms of Supply below. 

 

6.4 We have made every effort to display as accurately as possible the colors and images of our products that appear in our online store. We cannot guarantee that your computer monitor's display of any color will be accurate.

 

6.5 We reserve the right, but are not obligated, to limit our Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. We reserve the right to discontinue any product or Services at any time. Any offer for any product or Services made on this site is void where prohibited.

 

6.6 We do not warrant that the quality of any Services, information, or other material obtained by you will meet your expectations, or that any errors in the Services will be corrected. Nothing in this paragraph affects your statutory consumer rights.

8.3 We make no guarantee, representation or warranty of any kind, including express, implied statutory or otherwise, that your use of our Services will be uninterrupted, timely, secure or error-free, nor that the content presented on our Site and/or results that may be obtained from the use of the Services will be accurate or reliable, nor that the server making the Site available will be free of viruses or other electronic malware, spyware, or damaging code, nor that the version of the Site you access represents the full functionality, accuracy or reliability or our Site. 

 

8.4 You expressly agree that your use of, or inability to use, the Services is at your sole risk. We shall not be liable or responsible to you for any loss of content or material uploaded or transmitted through our Site. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

 

8.5 Subject to 9.1 and 9.2 above, other than as expressly provided in these Terms of Service, and our Customer Terms of Supply below, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

 

8.6 Subject to 9.1 above, in no case shall WET Environmental Ltd, or its parent, subsidiary or holding companies, nor our collective directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with the terms and conditions for any: economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or loss of goodwill or reputation; or loss of privacy and loss of data; or special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these Terms of Service.

 

8.7 In any event, though subject to 9.1 above, our total liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for any product or services on the basis set out in section 24 ‘Our Responsibility for Loss or Damage Suffered by You’ of our Customer Terms of Supply.

9.1 This section contains some further provisions that explains or clarifies legally how these Terms of Service will work in different situations to help make sure both us and our users can be more certain about what would happen if there were a problem.

 

9.2 If there is ever a problem that you experience, we would always encourage you to contact us immediately via our customer service email ‘customer_service@pureionicwater.com’ so that we can have the opportunity to fix or improve our Services and find a solution that works for everyone.

 

9.3 In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, any such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party except as required by law.

 

9.4 The obligations and liabilities incurred by you when using our Site shall survive any termination of your use of the Site. For example, if you post a comment that causes offence and later delete it and discontinue your access to our Site, an older version or screenshot of our Site containing your comment may still be accessible by someone, and your liability under our Terms of Service for that comment would still be in force.

 

9.5 The failure of us to exercise or enforce any right, power, remedy or provision of these Terms of Service shall not constitute a waiver of such right, power, remedy or provision. No waiver by us shall be effective unless in writing and signed by a legally authorised representative of WET Environmental Ltd.

 

9.6 These Terms of Service, Customer Terms of Supply, and Privacy Policy constitute the entire agreement and understanding between you and us, and govern your use of our Site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service, Customer Terms of Supply, and Privacy Policy).

 

9.7 These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed solely and exclusively in accordance with the laws of England and Wales. Any dispute raised by you against us in relation to these Terms of Service must be raised under the jurisdiction of the courts of England and Wales. If we need to raise a dispute with you in relation to these Terms of Service, we reserve the right to bring proceedings in the courts in any location/forum that we feel is appropriate for the nature of the dispute or defendant.
